Sherry Chen's Fight for Justice and Fairness
From May 24, 2012 when an informant wrongly accused Sherry Chen of security violations as “a Chinese National,” we have now entered the seventh year in Sherry's fight for justice and fairness.
As an innocent, award-winning hydrologist whose work is to save American lives and properties at the National Weather Service, Sherry Chen has already won two important uphill battles during this time period despite the statistical low odds.
The government dropped the criminal case against Sherry Chen in 2015, confirming her innocence. We learned subsequently that the investigative agents appeared to have altered or concealed exculpatory evidence that are in favor of Sherry Chen. Purported checks and balance in our system failed Sherry Chen.
Despite the dismissal of the criminal charges, the Department of Commerce (DOC) proceeded to fire Sherry Chen in 2016 based on the same failed and false justifications. DOC did not conduct a thorough review to examine what went wrong with its original allegations and actions, but instead pushed forward its hostile termination without objective consideration of facts and evidence.
Sherry Chen appealed the DOC decision and won a blockbuster decision at the Merit Systems Protection Board (MSPB) in April 2018. The MSPB judge agreed that Sherry Chen is a victim of "gross injustuce" and reinstated Sherry to her position with backpay and benefits.
The MSPB further observed that DOC midhandled the Sherry Chen case at multiple levels in the process. In short, the proposing and decising officials at DOC "seemed more concerned about being right than doing the right thing. Based on the unyielding nature of their testimony, I would not have been surprised if they rejected that 2 + 2 = 4," the judge wrote in her decision.
With all the overwhelming evidence of wrongdoing, DOC still refuses to acknowledge its mistakes and prejudice. It filed a challenge to the MSPB decision in June 2018, continuing its misuse of lawyers, time delays, and waste of our tax dollars to persecute an innocent Chinese American scientist.
All along, it was clear that the injustice faced by Sherry Chen is not her fight alone. Racial profiling of innocent Asian Americans is un-American, illegal, and morally indefensible. We cannot simply accept to serve as collateral damage, scapegoats, or convenient targets.
Despite the experiences of the past six years, Sherry Chen is confident and optimistic that justice and fairness will prevail in her case. Congressional members, community organizations, the U.S. Civil Rights Commission, and many donors, supporters and concerned individuals have stood by Sherry Chen through these years in sunny days and freezing cold. From mainstream media to community and social media, they have been telling the story of Sherry Chen.

On XXX, Sherry Chen announced that she has formed a legal team to file a lawsuit against the government for wrongful arrest and malicious prosecution. The legal team will be led by Stephen Simon and Peter J. Toren. Mr. Simon represents Sherry Chen's in the MSPB appeal. Mr. Toren is an experienced "This lawsuit is not only for Sherry Chen's justice and fairness, but also symbolic for all innocent, hardworking and loyal Chinese Americans," Sherry Chen said.
