2019/04/01 Government Delays Response to Sherry's FTCA Lawsuit
Sherry's legal team issued a summons (an order to respond to court) to the government on February 4, 2019. The government is obligated to respond in 60 days (see lawsuit flowchart in FAQ), but requested an extension of 3 weeks on April 1. The court approved the extension request on April 2. Now the government has until April 26 to respond. Visit Pending Actions to look at the updated count-down clock for this government response and count-up clocks on other pending actions.

On January 18, Sherry Chen’s legal team filed a lawsuit, Case 1:19-cv-00045-TSB, against the U.S. government alleging malicious prosecution and false arrest of Sherry Chen. Ms. Chen is a loyal, award-winning U.S. citizen whose hydrology work saved American lives and properties in the Ohio River Valley. A 135-page decision by the Merit Systems Protection Board calls her a victim of “gross injustice.” However, after her criminal case was dismissed by the government and the federal judge’s ruling to reinstate her to the National Weather Service with back pay and benefits, justice to Sherry Chen is still delayed and denied. “What happened to Ms. Chen should not happen to any American ever again,” said attorney Michele Young. After several email exchanges during the past month, the Sherry Chen Legal Defense Fund turned over a whistleblower letter to the Inspector General (IG) at the Department of Commerce (DOC) on August 15, 2018. The whistleblower letter alleges abuse of authority and targeting of Ms. Sherry Chen and employees of Asian ancestry in DOC. It provides the identity of offices, individual names, and specific incidents. The IG has assigned a complaint number: 18-0999.
The Fund’s August 15 cover letter to the IG office explains the need to protect the whistleblower, ensure integrity of the process, and preserve evidence. In addition, the Fund requests the IG to provide its intake process and standard operating procedures that would include, but are not limited to, third-party oversight, basic steps and potential timetable, and reports of progress and findings. The Fund requests that all reports shall be made public. A copy of the letter was sent to the Senate Judiciary Committee, Congressional Asian Pacific American Caucus, and the Office of Special Counsel.

Ten weeks ago, Sherry Chen, an award-winning scientist with the National Weather Service, finally received the vindication she had been waiting for. On April 23, Chief Judge Schroeder of the Merit Systems Protection Board issued a 120+-page decision thoroughly rejecting the many bogus reasons that the Department of Commerce had cited to justify Sherry’s discriminatory termination from the NWS in March 2016 – and her wrongful arrest in October 2014 -- and ordered the Department to immediately reinstate her employment and pay her back pay and benefits. This “gross injustice,” as the Judge described it, occurred under the prior administration in Washington.
Yet, instead of apologizing to Sherry, today the Department filed a brief with the MSPB appealing the decision. This appeal could delay Sherry’s obtaining justice for years. Adding insult to injury, during the pendency of the appeal the agency has refused to allow Sherry to return to work at the NWS, claiming that her presence at the Wilmington, Ohio office would be “unduly disruptive.” DOC’s actions are outrageous.
